Why are there disputes about inheritance?
There can be many reasons why there are disputes about inheritances, also known as contentious probate. They can include:
- Allegations that the executors or people dealing with the estate are not properly administering it. For example, they may not be transferring assets to the right people in a timely way.
- There can be concerns about the validity of the Will, including whether there was undue influence placed on the deceased when they were making the Will or whether they had capacity at the relevant time.
- It may be that either under their Will or (if they did not leave a Will) the laws of Intestacy, the deceased did not make reasonable provision for people who were dependent on them. This may mean that there is a claim under the Inheritance (Provision for Family and Dependants) Act 1975.
